فسخ اتفاقية تفويض المرفق العام للجماعات الاقلمية

Résumé: تمتلك السلطة المفوضة الوسائل القانونية التي تؤهلها لوضع نهاية لعقد تفويض المرفق العام المحلى في مواجهة المفوض له، من دون الحاجة على النص عليه في اتفاقية التفويض أو دون الحاجة للجوء إلى القضاء وتختلف صور فسخ اتفاقية تفويض المرفق العام باختلاف الأسباب المؤدية لها، حيث كرس المرسوم التنفيذي رقم 18-199 المتضمن تفويضات المرفق العام، عدة صور لفسخ العقد، ويمكن تصنيفها إلى فسخ جزائي ناتج عن إخلال المفوض له بالتزاماته بالتعاقدية وإلى فسخ تقديري ناتج عن مقتضيات المصلحة العامة، مع الوقوف في إطار هذه الدراسة على مدى فعالية لأحكام المنظمة لصور الفسخ والإشارة إلى الإشكالات القانونية التي تطرحها آليات الفسخ والآثار المترتبة عنها.
