مقومات المحضر القضائي في تكريس مبدأ الوجاهية قراءة في القانون 06-03 المعدل والمتمم

Résumé: إن مهمة المحضر القضائي كضابط عمومي معول عليه في إطار تحسين جودة العمل القضائي لهو مبتغى عظيم ينشده فاعلي جهاز القضاء وفي مقدمتهم فقهاؤهم لذا كانت مبادرة المشرع الجزائري في هذا السياق ظاهرة ومتسقة مع هذا المقصد بحيث تم تعديل القانون المنظم لمهنة المحضر القضائي بما يحقق نجاعة العمل القضائي من خلال عمل المحضر القضائي ليكون عملا مسهما بإيجابية وفاعلية فهو حلقة الوصل التي لا يجب أن تفقد في إطار تكريس نظام قضائي موحد و مزدهر بكل المبادئ التي يسعى الجميع إلى تحقيقها ومن بينها عدالة وجودة الاحكام التي لا يمكن أن تتم دون إحترام تلك المبادئ وعلى رأسها مبدأ الوجاهية المنوط للمحضر تكريسه بكل ماله من أدوات في هذا الإطار. The role of the judicial officer as a public official entrusted with enhancing the quality of judicial work is a significant objective sought by the actors within the judicial system, particularly its legal scholars. In this context, the Algerian legislator's initiative stands out as a clear and consistent step toward achieving this goal by amending the law governing the profession of judicial officers. This amendment aims to ensure the efficiency of judicial processes through the contributions of judicial officers, making their work positively and effectively impactful. They serve as a crucial link that must not be overlooked in the establishment of a unified and flourishing judicial system rooted in principles such as justice and the quality of rulings. These principles cannot be fully realized without respecting foundational concepts, foremost among them being the principle of adversarial proceedings, which the judicial officer is tasked with upholding through the tools and mechanisms at their disposal.
