Means Of Proof In Matters Of Marriage And Its Effects وسائل الإثبات في مسائل الزواج وآثاره

Résumé: الخطبة مجرد وعد بالزواج، ولأطرافها حق العدول عنها، ومتى تم العدول ألزم القانون الطرف العادل أن يرد الهدايا للمعدول عنه الذي قد يلحقه ضرر من هذا العدول، ومتى ثار النزاع حول الهدايا أو التعويض عن الضرر، فعلى المدعي تدعيم دعواه بوسائل إثبات، كما أن للزواج جملة من الآثار منها الصداق، النسب، والنفقة والأموال المشتركة، وقد يثور النزاع حول أحد هذه الآثار، فإن للقاضي أن يطالب بحق له أن يعزز طلبه بوسائل إثبات، والمشرع في مسائل الزواج لم يحدد وسيلة إثبات معينة وإنما ترك ذلك لتقدير قاضي الموضوع ومن الوسائل الشائعة الإستعمال في هذا الموضوع الرسائل المكتوبة، الصور، التسجيلات الصوتية، شهادة الشهود، اليمين، الإقرار...إلخ، وكل ما يساهم في تكوين قناعة القاضي ليصدر حكما عادلا منصفا. Engagement is just a promise of marriage, and the parties have the right to abandon them. And when the reversal takes place, the law obliges the just party to return gifts to the reverted person, who may be harmed by this reversal, Marriage also has a number of effects, including the dowry, lineage, alimony and joint funds. A dispute may arise over one of these effects, for the judge may claim a right for him to support his request by means of proof. In matters of marriage, the legislator did not specify a specific means of proof, but rather left that to the discretion of the case judge. Among the commonly used means in this matter are written messages, photographs, audio recordings, witness testimony, oath, confession… and everything that contributes to forming the judge’s conviction to issue Just and equitable judgment.
