اشكاليات التوسع المستقبلي للاختصاص الموضوعي للمحكمة الجنائية الدولية

Résumé: الملخص: إنّ مفهوم الجريمة واسع ومتعدد، وان كان أول ما نسمع كلمة الجريمة نميل إلى التفكير في الجرائم التقليدية، بيد أنّ مفهوم الجريمة اليوم قد تغيّر عن ذلك التقليدي لتتعدى آثارها الحدود نحو الدولية، ليقوم المجتمع الدولي بعد انتهاكات الحرب العالمية بالبحث عن آلية قضائية دولية لمتابعة مرتكبيها. وتحقق ذلك من خلال المحكمة الجنائية الدولية التي يضم اختصاصها الموضوعي مجموعة من الجرائم جاءت بقائمة محدودة متجاهلة مجموعة أخرى من الجرائم الدولية ربما أشد خطورة من تلك المنصوص عليها على غرار الجريمة الارهابية وجرائم المخدرات والاتجار بالبشر، وهو ما يدعو لمراجعة النظام مستقبلا وتوسيع الاختصاص ليشمل كل أصناف الجرائم الدولية المعروفة حاليا. Abstract: The concept of crime is wide and varied, and if the first time we hear the word crime we tend to think of traditional crimes, however, the concept of crime today has changed from that traditional one because its effects transcend international borders, so that the international community, after the violations of the World War, searches for an international judicial mechanism to prosecute the perpetrators. . This was achieved through the International Criminal Court, whose substantive jurisdiction includes a group of crimes that came with a limited list, ignoring another group of international crimes, perhaps more serious than those provided for, such as terrorist crime, drug crimes and human trafficking, which calls for reviewing the system in the future and expanding jurisdiction to include all types of crimes.
