جريمة إختلاس الأموال العمومية وإجراءات المتابعة فيها

Résumé: الاختلاس في القطاع العام والخاص ظاهرة متعددة الجوانب نظرا لتعدد صورهومظاهره التي أخذت تتجاوز حدود الدولة ولم يعد من الممكن مجابهته في إطار أحكامالتشريعات الوطنية، والإجراءات التقليدية، لذا اهتمت الدول والمنظمات الدوليةالعالمية والإقليمية بهذه الظاهرة، وبذلك العديد من الجهود لمواجهة هذه الجريمة التي تكرست في اتفاقية الأمم المتحدة لمكافحة الفساد لسنة 2003، والتي كان لها الأثر المباشر في تعديل المنظومة التشريعية والسياسية لمجابهة هذه الجريمةتأثر المشرع الجزائري بهذه الاتفاقية، وسن قانون الوقاية من الفساد ومكافحتهبعد أن كانت هذه الجريمة معاقب عليها في قانون العقوبات. هذا القانون جاء بمجموعةمن الإجراءات غير المعروفة في قانون الإجراءات الجزائية، وذلك فيما يخص المتابعة،وأساليب البحث والتحري، كما نص أيضا على نظام خاص بتقادم الدعوى العموميةوالعقوبة ونص أيضا على التعاون الدولي في محاربة هذه الجريمة من خلال إقامة علاقات تعاون قضائي على أوسع نطاق مع الدول الأطراف في الاتفاقية في مال التحرياتوالمتابعات والإجراءات القضائية المتعلقة بالفساد. الكلمات المفتاحية: الاختلاس في القطاع العام؛ قانون الوقاية من الفسادومكافحته؛ الفساد؛ وأساليب البحث والتحري. Abstract: Embezzlement in the public and private sector is a multifacetedphenomenon due to the multiplicity of its forms that have gone beyond theborders of the state, and can no longer be confronted within the framework of thenational legislations and traditional procedures, this is why countries, regionaland international organizations have taken care of this phenomenon, and by this,many efforts to confront this crime amongst the United Nations Conventionagainst corruption in 2003, which had a direct impact on legislative and politicalsystems to confront this crime. Algerian legislature was affected by this Convention, concretized in theenactment of Prevention and fight corruption law, after this offense waspunishable in Penal Code. This law introduces a set of procedures unknownbefore in the Criminal Procedure Law, with regard to follow-up, research andinvestigation methods, and also provides for a special statute of limitations forpublic prosecution and punishment, and also provides for internationalcooperation in combating this crime by establishing judicial cooperation relationson the widest scale With the states parties to the agreement in the area ofcorruption investigations, prosecutions, and judicial procedures.
