الخطــأ الطبـي الجراحـي دراسة مقارنة بين الشريعة الإسلامية والقانون الوضعي
Résumé: تتناول هذه الدراسة المسؤولية عن الخطأ الطّبي الجراحي في الشريعة والقانون، حيث تلقي الضوء على طبيعة الخطأ المرتب للمسؤولية الطبية في القانون المدني والجنائي وبعض القوانين الخاصة. ومن ناحية أخرى تظهر هذه الدراسة مدى شمولية الشريعة الإسلامية وصلاحيتها لكل زمان حتى في المجال الطبي الحديث. وقد قسمت هذه الدراسة إلى مبحث تمهيد للتعريف بالمسؤولية وأنواعها ومن ثمة إلى فصلين، درست في الفصل الأول مفهوم الخطأ الطبي وصوره ومعاييره، وكذا شروط ممارسة العمل الطي، في حين تطرقت في الفصل الثاني إلى تحديد نطاق جرائم الخطأ الطبي الجراحي والعقوبات المقررة لذلك في الشريعة الإسلامية والقانون. This study deals with responsibility for the surgical medical error in law and the law, where shed light on the nature of the error salary for medical liability in civil and criminal laws and some special law. On the other hand, this study shows the comprehensiveness of Islamic law and its validity for all times, even in the modern medical field. The study was divided into Study pave the definition of responsibility and types are there to two, I studied in the first chapter the medical error and manifestations and standards concept, as well as the conditions for the exercise of medical work, while touched in the second chapter to determine the scope of medical error surgical crimes and the penalties prescribed for that in Islamic law and the law.
