الجهات القضائية الإدارية المتخصصة كاستثناء من مجال تطبيق قانون الإجراءات المدنية والإدارية Specialized Administrative Judicial Bodies As An Exception To The Scope Of Civil And Administrative Procedures Law Enforcement

Résumé: أخذت الجزائر بقضاء التأديب بخصوص انضباط القضاة والأخطاء التأديبية التي يرتكبها المحامي والموثق والمحضر القضائي ومحافظ البيع بالمزيدة، إذ نص المشرع على العديد من الجهات القضائية الإدارية المتخصصة التي تنظر في هذا النوع من القضاء بالإضافة إلى مجلس المحاسبة. وتصدر الجهات القضائية الإدارية المتخصصة قرارات قضائية نهائية تقبل الطعن بالنقض أمام مجلس الدولة، غير أنها أثناء النظر في الطعون المرفوعة أمامها تستعين بجملة من الإجراءات والضمانات المنصوص عليها في القوانين الخاصة، مستبعدة بذلك تطبيق قانون الإجراءات المدنية والإدارية، هذا الأخير يطبق فقط بخصوص الطعن بالنقض في قرارات الجهات القضائية الإدارية المتخصصة. Algeria has taken disciplinary judgments regarding the discipline of judges and disciplinary errors committed by the lawyer, notary, judicial record, and sales governor, with more, as the legislator has stipulated many specialized administrative judicial bodies that consider this type of judiciary in addition to the accountability board. Specialized administrative judicial bodies issue final judicial decisions accepting cassation appeals before the State Council, but during the consideration of appeals filed before them, they use a number of procedures and guarantees stipulated in the special laws, excluding the application of the Civil and Administrative Procedures Law, the latter applies only with regard to cassation appeals in The decisions of the specialized administrative judicial authorities.
