المنازعات المتعلقة بالمستثمرات الفلاحية في التشريع الجزائري

Résumé: إن منازعات المستثمرات الفلاحية في القانون الجزائري هي نتاج صدور عدة نصوص قانونية أصدرها المشرع بغية تكوين وعاء عقاري الأمر الذي طرح إشكالات عويصة أمام القضاء المختص بالفصل فيها وكذا على أطراف المنازعة أنفسهم سواء الإدارة أو المستفيدين، وهذا ما عالجناه في دراستنا غير أنه رغم تشعب وتعقيد بعض المنازعات، إلا أن القضاء قد بادر في العديد من القرارات القضائية الصادرة عن المحكمة العليا ومجلس الدولة إلى إيجاد حلول لها ساعيا للفصل فيها لكنه لم يوفق بل وكانت جل هذه القرارات في بعضها متناقضة مما يستعدي على المشرع توحيد الاجتهاد القضائي والعمل به. الكلمات المفتاحية: المستثمرات الفلاحية، الاستصلاح، منازعات الامتياز، نزع الملكية للمنفعة العامة، إرجاع الأراضي لملاكها الأصليين، الأراضي المدمجة في القطاع العمراني.The disputes of agricultural women investors in Algerian law are the result of the issuance of several legal texts issued by the legislator with the aim of forming a real estate container, which raised serious problems before the competent judiciary, as well as on the parties to the dispute themselves, whether the administration or the beneficiaries, and this is what we addressed in our study, but despite the complexity and complexity of some disputes However, in many judicial decisions issued by the Supreme Court and the State Council, the judiciary has taken the initiative to find solutions to them, seeking to adjudicate them, but it was not successful, and most of these decisions were in some of them contradictory, which antagonizes the legislator to unify the jurisprudence and work with it.
