الحماية القانونية للأشخاص من جريمة الاختفاء القسري في القانون الدولي

Résumé: الملخص: الاختفاء القسري ظاهرة قديمة عرفتها البشرية لوجود منطق القوة داخل المجتمعات، وجديدة في المجتمعات الحديثة في ظل الحروب والنزاعات المسلحة، ظاهرة مست الأمن والسلم ما نتج عنها من نزاعات وصراعات في الغالب تؤدي للحروب، ومست حقوق الإنسان فألحقت به الإهانة والمهانة، مما نتج على أن الاختفاء القسري جريمة ضد الإنسانية طبقا لنظام روما الأساسي للمحكمة الجنائية الدولية، وأن الاتفاقيات الدولية هي أساسا قانونيا للحماية منها، وتعد الأجهزة الدولية والإقليمية آليات تصدى بها المجتمع الدولي لهذه الجريمة، أردنا من خلال هذه الورقة البحثية تبيان الحماية القانونية للأشخاص من جريمة الاختفاء القسري، وكذا معرفة الاتفاقيات الدولية والإقليمية التي نصت على هذه الحماية ثم لنعرف أو نعرض إلى أهم الآليات الدولية المخصصة لتطبيق هذه الحماية القانونية. Summary: Enforced disappearance is an ancient phenomenon that humanity has known for the logic of power within societies, and also new in modern societies in times of war and armed conflict. This phenomenon has affected peace and security, resulting in conflicts that often lead to war. Human rights have also been violated, and humiliated. Enforced disappearance is a crime against humanity in accordance with the Rome Statute of the International Criminal Court, and international conventions are essentially a law of protection against it. In this paper we attempt to demonstrate the legal protection of persons against the crime of enforced disappearance, as well as the international and regional conventions that provided for such protection, and then to address the most important international mechanisms for applying this legal protection.
