دور هيئات رصد المعاهدات الدولية لحقوق الإنسان في تقييم تحفظات الدول الأطراف

Résumé: الملخص: تنص معظم معاهدات حقوق الإنسان الدولية على تشكيل لجان )هيئات( يُناط بها مراقبة مدى تنفيذ الدول الأطراف لالتزاماتها التعاهدية. هذه الهيئات تعمل ضمن أطر مرسومة ومحددة لها في متن المعاهدة. وتجنبا لأي إشكالات عملية في تنفيذ بنود المعاهدة، قد تلجأ الدولة الطرف إلى إبداء تحفظ على مادة بعينها من المعاهدة. فإذا قُبل التحفظ، تصبح الدولة غير مُلزمة بالوفاء بالمادة المُتحفظ عليها.أما إذا اُعتُبر التحفظ متعارضا مع غرض وموضوع المعاهدة ، فلا يُقبل، وحينها تُعد الدولة مُلزمة بتنفيذ نص المادة المُتحفظ عليها. ومن بين مهام الهيئات إصدار بعض التعليقات والآراء حول التحفظات التي تبديها الدول الأطراف على بعض أحكام معاهدات حقوق الإنسان، هذه الآراء أو التعليقات قد تتضمن توجيهات للدول بسحب تحفظها أو تعديله بما لا يتعارض مع موضوع المعاهدة وغرضه، مما يستدعي رد الدولة الطرف المعنية للتعامل مع هذه الحالة بالانصياع أو الرفض باعتبارها صاحبة السيادة في اتخاذ ما تراه مناسبا حماية لمصالحها العامة ونظامها القانوني . Abstract: Most human rights treaties provide for the formation of committees to monitor the extent to which States parties implement their obligations. These bodies operate within established and specific frameworks within the treaty body. And to avoid any practical problems in implementing the provisions of the treaty, The State party may resort to a reservation to a specific article of the treaty, If the reservation is accepted , The state is not obliged to apply the text of the article that has expressed reservations, However, if the reservation made is considered incompatible with the object and purpose of the treaty, then it is not acceptable. Among the functions of the bodies are to issue some comments and opinions on the reservations made by States parties to certain provisions of the human rights treaties. These views or comments may include instructions for States to withdraw or modify their reservation in a way that does not conflict with the object and purpose of the treaty. Which necessitates the response of the State party concerned to deal with this case by submitting or rejecting it, as it has the authority to take what is appropriate for it to protect its public interests and its legal system.
