المسار المهني للموظف في مجال الترقية

Résumé: تتمحور هذه المذكرة حول موضوع ترقية الموظف العمومي في إطار التشريع الجزائري ، باعتباره من المواضيع الجوهرية في مجال الوظيفة العامة ، لما تحققه الترقية من أثر إيجابي سواء على المستوى المادي أو المعنوي للموظف، فضلاً عن مساهمتها في تحسين أداء الإدارة العمومية وتقديم خدمات ذات جودة للجمهور ، وتُعد الترقية حقاً قانونياً يضمنه المشرّع لكل موظف تتوفر فيه شروط الأقدمية والكفاءة والمؤهلات العلمية أو التكوينية، حيث تلتزم الإدارة المختصة بإصدار قرار الترقية متى استوفى الموظف الشروط القانونية ، ما لم توجد موانع قانونية تحول دون ذلك، ويحق للموظف التظلم من قرار حرمانه من الترقية إذا شابه تعسف، كما يمكنه اللجوء إلى القضاء الإداري للطعن في القرار إذا لم تتم تسويته على المستوى الإداري.This memorandum focuses on the subject of public employee promotion within the framework of Algerian legislation. This is a fundamental topic in the field of public service, given the positive impact it has on both the material and moral levels of the employee, as well as its contribution to improving the performance of public administration and providing quality services to the public. Promotion is a legal right guaranteed by the legislature to every employee who meets the requirements of seniority, competence, and academic or training qualifications. The competent administration is obligated to issue a promotion decision whenever the employee meets the legal requirements, unless there are legal impediments to this. An employee has the right to appeal a decision denying him or her a promotion if it is deemed arbitrary. He or she may also resort to the administrative judiciary to appeal the decision if it is not settled at the administrative level. Keywords: Public employee, promotion, public service.
