ضابط الإختصاص في منازعات إستثمار الأوقاف

Résumé: ملخص: ينصرف مفهوم الاختصاص القضائي إلى صلاحية المحكمة للبت في الدعوى المعروضة عليها ويميز عادة في الاختصاص بين النوعي والمحلي ، فأما الاختصاص المحلي فهو الذي يعطي للمحكمة صلاحية الفصل في الدعوى بناءا على أساس جغرافي، أما الاختصاص النوعي فهو الذي يمنح النظر للمحكمة بناء على نوع الدعوى ، وفي ظل الاعتداءات المتكررة على الأملاك الوقفية ومنح الوقف الشخصية المعنوية وبالتالي الحق في التقاضي وجب تبيان الجهات القضائية المختصة بالفصل في المنازعات التي تثار بمناسبة تضارب مصالح مالية لأشخاص ذوي صلة بالوقف سواء كان ذلك نتيجة لوقائع مادية أو قانونية، وبغية توضيح مدى إخضاع المشرع الجزائري المنازعة الوقفية للقواعد العامة في الاختصاص ارتأينا تبيان ذلك من خلال هذه الورقة البحثية. :Abstract The concept of jurisdiction refers to the court’s authority to decide the case brought before it, and it usually distinguishes between qualitative and local jurisdiction. As for local jurisdiction, it gives the court the authority to decide on the case on a geographical basis, while qualitative jurisdiction is the one that grants consideration to the court based on the type of case. In light of the repeated attacks on endowment properties, and granting the endowment to a legal personality and thus the right to sue, it is necessary to clarify the judicial authorities competent to settle disputes that arise due to a conflict of financial interests of persons related to the endowment, whether as a result of material or legal facts, and in order to clarify the extent to which the Algerian legislator is subject to the dispute Endowment for the general rules in the jurisdiction We decided to demonstrate this through this research paper.
