النظام القانوني للجان الإدارية المتساوية الأعضاء في التشريع الجزائري

Résumé: تعتبر اللجان الادارية المتساوية الأعضاء في جزء لا يتجزأ من نظام الوظيفة العامة والمرفق العام، فقد أسند القانون لها مهام توسعت وتطورت بتطور الوظيفة العامة وعلاقة الموظف بالإدارة، وحتى يحمي المشرع الموظف من تعسف الادارة اتجاهه، فقد أنشأت هذه اللجان التي تشكل مظهرا من مظاهر مشاركة ومساهمة الموظف في تسيير حياته الوظيفية في الجزائر لأول مرة في قانون الوظيفة العمومية 66-133 ثم توال النص عليها في مختلف النصوص القانونية المتعلقة بالوظيفة العمومية وآخرها الأمر رقم 06-03 المتضمن القانون الأساسي العام للوظيفة العمومية كما أعيد تنظيمها مؤخرا بصدور المرسوم التنفيذي رقم 20-199 الذي حدد من خلاله المشرع تنظيم اللجان الإدارية المتساوية الأعضاء في المؤسسات والإدارات العمومية من خلال تشكيلتها واختصاصاتها وسير عملها. الكلمات المفتاحية: اللجنة، المتساوية، الأعضاء، المشاركة Summary: The administrative committees are considered equal members in an integral part of the system of the public office and the public utility. The law assigned them tasks that expanded and developed with the development of the public position and the employee’s relationship with the administration, and in order for the legislator to protect the employee from the abuse of the administration towards him, these committees were established, which constitute a manifestation of participation and contribution. The employee in the conduct of his career in Algeria for the first time in the Public Service Law No. 133-66, then it was repeatedly stipulated in the various legal texts related to the public service, the latest of which was Ordinance No. 06-03 containing the General Basic Law of the Public Service, as it was recently reorganized with the issuance of Executive Decree No 20-199 Through which the legislator determined the organization of administrative committees of equal members in public institutions and administrations through their formation, terms of reference and workflow.
