حدود حرية الإدارة في التعاقد في مجال الصفقات العمومية وتفويضات المرفق العام من خلال تكريس شروط المنافسة

Résumé: الملخص تتمحور الدراسة حول البحث عن حدود حرية الإدارة في التعاقد في ظل النقلة النوعية التي عرفها مجال الصفقات العمومية وتفويضات المرفق العام بموجب القانون رقم 08/12، المتعلق بالمنافسة المعدل والمتمم بالقانون رقم 10/05 والكشف عن العلاقة القائمة بين حرية الإدارة في التعاقد وبين مبدـأ حرية المنافسة ونظرا للخصائص التي تميز الصفقات العمومية وتفويضات المرفق العام على اعتبار أنها عقودا إدارية، أين تتمتع فيها الإدارة بحقوق وامتيازات لا تتاح للطرف المتعاقد معها بهدف تحقيق الموازنة بين المصلحة العامة والمصلحة الخاصة، مما جعل المشرع من حرية الإدارة في التعاقد مشروطة ومحدودة من خلال التقيد بأحكام القانون التي تحظر الممارسات المقيدة للمنافسة والتي تحد من حرية الدخول في الأسواق وعرقلة حرية تحديد الأسعار طبقا لقواعد الطلب والعرض. Abstract: The subject matter of this study revolves around searching the limits of the administration’s freedom of contracting in light of the specific shift in the field of public procurement and delegations of public service, under the Law No.12/08, pertaining to competition, as amended and supplemented by the Law No.05/10; in addition to revealing the existing relationship between the administration’s freedom in contracting and the competition freedom principle. In view of the characteristics distinguishing the public procurement and delegations of public service as administrative contracts, whereat the administration enjoys rights and privileges that are not given to the contracting party, with the aim to attain a balance between the public interest and the private interest, the fact of which has pushed the legislator to make from the administration’s contracting freedom conditional and limited, all the way through complying with the provisions of the law that prohibit the practices that restrict competition and limit the freedom of entering in the markets and impeding the freedom of setting prices according to the rules of demand and supply.
