دور السلطة الإدراية في حماية البيئة من مضار المؤسسات المصنفة

Résumé: في إطار تطبيق الأحكام الدستورية المتعلقة بحرية التجارة والصناعة فقد تم إنشاء العديد من المؤسسات المصنفة، التي تضمن سير عجلة التنمية، لكن على الرغم من أهمية هذه المنشآت فإن لها آثار سلبية على البيئة من خلال الأضرار التي تترتب عنها، ولا سيما التلوث بمختلف أنواعه، وعلى هذا الأساس تتمتع سلطة الإدارة في حماية البيئة بامتيازات السلطة العامة ومنها سلطة الضبط الإداري ضد نشاطات المؤسسات المصنفة الضارة بالبيئةـ، حيث تلعب السلطة الإدارية من خلال نشاطها الضبطي دورا فعالا في حماية البيئة من التلوث الصادر عن هذه المؤسسات استنادا على القواعد القانونية والوسائل الإدارية المتاحة ، بهدف تحقيق النفع العام و لمنع حصول هذه الأضرار أصلا، أو التقليل من آثارها. :Abstract In the framework of applying constitutional dispositions related to free trade and industry, many Classified establishments that assure good development rhythm was built. However, these facilities had negative impacts on environment such as different kinds of pollution and their harmful consequences. In this regard, the administrative authority has general prerogatives to protect environment including the power to make administrative regulations against activities of polluting establishments, Administrative authority plays, through its regulation activity, important roles in protecting environment against polluting facilities on the basis of legal rules and administrative means. The aim of such framework is to assure general interest and prevent harmful .damages or reduce their impacts
