دور الصلح في حماية الرابطة الزوجية

Résumé: يعتبر الصلح من أهم الوسائل البديلة لحل النزاعات، ومن الآليات التي لها أهمية كبيرة ودور فعال في حماية الرابطة الزوجية، ودعم استقرارها واستمرارها، وهذا من خلال حل النزاعات بطريقة ودية، وبالتالي الحد من حالات الطلاق إذا ما تم حسم النزاع و الشقاق القائم بين الزوجين عن طريقه، فلا يمكن للحياة الزوجية أن تستمر في ظل وجود الشقاق والنزاع بين الزوجين. ومنه فإن نجاح الصلح كآلية لتسوية النزاعات الأسرية رهينة بمدى الاستعداد الذي يبديه الزوجان المتخاصمان في التفاوض والتصالح، كما أنه متوقف على خبرة القاضي و كفاءته في القيام بهذه المهمة على أحسن وجه، والتفرغ لذلك والغوص في معرفة أسباب النزاع وتوعية الزوجين بأهمية الصلح، وكذا منح مهلة كافية للقيام بإجراء الصلح. Reconciliation is considered as one of the most important alternative means of resolving disputes, and it is one of the mechanisms that have great importance and an effective role in protecting the marital bond, and supporting its stability and continuity, and this is through amicably resolving disputes, and thus reducing divorce cases if the conflict and discord between the spouses are resolved from His way, married life cannot continue in the presence of discord and conflict between spouses. Hence, the success of reconciliation as a mechanism for settling family disputes depends on the extent of the willingness of the quarreling spouses to negotiate and reconcile, and it also depends on the judge's experience and competence in carrying out this task in the best way, and devoting himself to that and diving into knowing the causes of the conflict and educating the spouses about the importance of reconciliation, as well as granting a deadline Sufficient to do the reconciliation procedure.
