الخطأ في المسؤولية المدنية

Résumé: نسلط الضوء في هذه المذكرة على ركن الخطأ كركن أساسي في المسؤولية المدنية لما له تأثير كبير في مختلف المجالات، باعتباره السبب الرئيسي لوقوع المشكلة. ومجمل القول في بحثنا لهذا الموضوع تناولناه في فصلين. الفصل الاول: تعرضنا إلى الخطأ في المسؤولية المدنية وذلك بالتطرق إلى ماهية الخطأ في مبحث يشمل تعريفه، وحالات انتفائه، بالإضافة إلى ركنيه (الركن المادي، الركن المعنوي)، ثم انتقلنا إلى المبحث الثاني لندرس الخطأ التقصيري والعقدي كل في مطلب يشمل عناصر محددة، حيث تطرقنا إلى ماهية الخطأ التقصيري الذي يشمل تعريفه، وانواعه، إضافة إلى عناصر الخطأ التقصيري (العنصر المادي، العنصر المعنوي)، أما بالنسبة إلى الخطأ العقدي فيشمل تعريفه، وشروطه إضافة إلى مقياس تحقق الخطأ العقدي وكيفية إثباته. الفصل الثاني: تعرضنا إلى تطبيقات الخطأ في المسؤولية المدنية وذلك في مجالين محددين وهما المجال الطبي والبيئي، حيث تم التطرق إلى الخطأ الطبي في المبحث الاول وتم ذكر عناصره المتمثلة في تعريف الخطأ الطبي، وخصائصه، إضافة إلى معايير تقدير الخطأ الطبي وتقسيماته، ثم انتقلنا إلى المبحث الثاني لندرس الخطأ البيئي وذلك بذكر عناصر محددة تتمثل في تعريفه، واركانه، وصوره، إضافة إلى الصعوبات المرتبطة بإثبات الخطأ البيئي. Abstract Abstract In this note, we highlight the error corner as a basic pillar of civil responsibility because it has a great impact in various fields, as it is the main cause of the problem. In sum, we discussed this topic in two chapters. The first chapter: We exposed to the error in civil responsibility by addressing the nature of the error in a study that includes its definition, and cases of its absence, in addition to its two pillars (the material pillar, the moral pillar), then we moved to the second topic to study the tort and contract error, each in a demand that includes specific elements, where We discussed the nature of the default error, which includes its definition, and its types, in addition to the elements of default (the material element, the moral element), as for the contractual error, it includes its definition, conditions, in addition to the measure of verification of the nodal error and how to prove it. Chapter Two: We exposed to the applications of error in civil liability in two specific fields, namely the medical and environmental fields, where the medical error was addressed in the first topic and its elements were mentioned, represented in the definition of medical error, and its characteristics, in addition to the criteria for estimating medical error and its divisions, then we moved to The second topic is to study the environmental error by mentioning specific elements represented in its definition, pillars, and images, in addition to the difficulties associated with proving the
