دور القاضي الإداري في حل منازعات عقد الامتياز الفلاحي في ظل القانون 10-03

Résumé: ملخص: إن عقد الامتياز كنمط حصري لاستغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة؛ المتمخض عن السعي الدؤوب للسياسات المنتهجة بالجزائر للنهوض بعجلة التنمية الاقتصادية، لا سيما المرحلة الراهنة؛ أي جزائر ما بعد البترول، وباعتبار عقد الامتياز يرتب العديد من الحقوق والواجبات فإن أي اخلال بها يثير عديد المنازعات، والتي يعود لجهة القضاء الإداري سلطة الفصل فيها جنبا إلى جنب مع القضاء العادي. ومن هنا وجب ابراز دور القاضي الاداري في حل المنازعات المترتبة على عقد الامتياز في مجال العقار الفلاحي ذلك أن الادارة هي مانحة الامتياز عملا بالمعيار العضوي. ABSTRACT: The concession contract as an exclusive mode of exploitation of farmland belonging to the private property of the State, resulting from the diligent pursuit of the policies adopted by Algeria to promote the pace of economic development, Especially in the current phase, that is, post-oil Algeria: since the concession contract provides for many rights and duties, any violation of them raises many disputes that the judiciary has the power to judge alongside the ordinary judiciary.Therefore, the role of the administrative judge in resolving disputes arising from the concession contract in the field of agricultural real estate should be highlighted, So that the administration is the licensor according to the biological standard. .
