المسائل الفقهية التي خالف فيها ابن العربي مشهور مذهب المالكية من خلال كتابة عارضة الاجوذي شرح سنن الترميذي -جمعا ودراسة

Résumé: "ملخص البحث تتناول الدراسة المسائل الفقهية التي خالف فيها ابن العربي مشهور مذهب المالكية من خلالكتابه عارضة الأحوذي في باب الح ّج جمعا ودراسة، فكانت إشكالية البحث الرئيسة والتي أردنا الإجابة عليها؛ ما هي المسائل التي خالف فيها ابن العربي مشهور مذهب المالكية في باب الح ّج ومستنده في المخالفة؟ فقد أجاب البحث على ذلك من خلال (الجانب النظري) الذي كان في (المبحث الأول) وقد احتوى على ثلاثة مطالب، حيث خصصنا (المطلب الأول) للتعرف على ابن العربي والمذهب المالكي، و(المطلب الثاني) في بيان مصطلح المشهور في المذهب المالكي، و(المطلب الثالث) في بيان مفهوم الح ّج وشروطه وأركانه، أما (الجانب التطبيقي) فكان في (المبحث الثاني) والذي حوى المسائل التي خالف فيها ابن العربي مشهور المذهب، وقد توصلت الدراسة إلى جملة من النتائج وأهمها؛ أ ّن ابن العربي لم تكن مخالفته للمذهب عن هوى إنماكان يخالف بالح ّجة؛ كما أوصت الدراسة بالاعتناء بالتراث المالكي""Abstract This study is entitled by «The subjects which IBN AL ARABI disagree with most common rules of the MALIKI school» by writing casual Al ahwadhi in the chapter on AL HADJ agreed and studied. The main problem of this study Wich sought to answer it is: what are the subjects which IBN AL ARABI disagree with the most common rules of the MALIK school in the book of AL HADJ? and the thing that made him contradict. The study answered this through the first، second and third chapters، which deal with the theoretical aspect as we devoted then to getting to know IBN AL ARABI and the MALIKI school of thoughts well as the MASHHOUR and the concept of AL HADJ. and about the fourth topic، it was for the partial side، which includes issues in which the famous IBN AL ARABI disagreed، and it was twelve issues. This study come up with many results. The most important of IBN AL ARABI، is one of scholar's those who reach the diligence level and freed him from imitation and sectarian fanaticism moreover obtaining the most correct in matters of AL HADJ that are is dispute. Finally، this study recommended paying attention to the legacy of this IMAM'S and expanding research into his opinions and jurisprudence."
