خصوصية عقد الاستخدام البحري

Résumé: يخضع عقد الاستخدام البحري للقواعد العامة ، الا ان هناك نصوص خاصة بهذا العقد فرضتها طبيعة هذا العقد . ان الحياة في البحر يميزها الخطر و العزلة و هو الامر الذي يجعل هذه الحياة صعبة بالنسبة للبحار . و قد كان لهذه الاعتبارات اثر على العقود التي يبرمها البحار مع مالكي او مجهزي السفن و على وضعه بصفة عامة . ان الدولة تعرف الاهمية التي يمثلها البحار بالنسبة للاقتصاد الوطني لذلك تدخلت بفرض نصوص آمرة تتعلق بالشروط التي يجب توافرها فيمن يرغب في الالتحاق بهذه المهنة سواء من حيث اللياقة البدنية او من حيث المؤهلات و الشهادات. و قد عمدت الدول عن قصد الى تحسين وضع الملاح بتوفير حماية له لما يمثله الملاحين من قوة حية يعتمد عليها اقتصاديا . لكل هذه الاسباب تميزت العقود التي يبرمها الملاحين بخصوصية سنحاول ان نفصل فيها في هذا البحث . The maritime employment contract is governed by the rules of ordinary labor law; however, there are special rules that apply to this contract. This is because life at sea is characterized by two traits: danger and isolation. Taken together, these two traits can make life more difficult for the seafarer. That is why contracts concluded between the seafarer and the shipowner must take these two traits into account. The State is aware of the importance that seafarers have in the economic life of the country. This explains his intervention by mandatory texts relating either to the conditions of recruitment or to physical fitness or to the skills and diplomas that a seafarer must have. The States have on the other hand drawn up special statutes which could have advantages to promote the profession and recruitment. These considerations have largely influenced maritime employment contracts and give them a specificity that we will demonstrate in this article..
