اعتبار قصود المستفتي وقرائن أحواله - دراسة نظريَّة تطبيقيَّة -

Résumé: تتناول هذه الدِّراسة بالبحث والتَّحليل مسألة اعتبار مراعاة قصود ونوايا المستفتين في عمليَّة الفتوى، حيث قام الباحث في هذه الدِّراسة ببيان أهميَّة الفتوى ومكانتها في الشَّريعة الإسلاميَّة، كما أوضح خلالها أيضا مدى ارتباطها بمقاصد الشَّريعة الإسلاميَّة وأهميَّة ذلك في تسديد الفتوى وتصويبها، كما قام الباحث بتأصيل لمسألة اعتبار ومراعاة القصود والنَّوايا في الفتوى، وكذا التَّأصيل لنظرية الباعث والتَّدليل عليها، وذكر أقوال الفقهاء واختلافهم في هذه المسألة، كما قدَّم الباحث عرضا لأهمِّ المسالك والطُّرق والآليات التي يُمكن للمفتي اعتمادها في الكشف على القصود والنَّوايا المبطَّنة. وفي الختام ذكر الباحث بعضا من التَّطبيقات والأمثلة التي يُمكن تخريجها على الأصل المذكور في الدِّراسة. Abstract: By searching and analyzing the study which deals with the topic of taking into account the purposes and the intentions of the enquirers in the "FATWA", in which the researcher in this study did show the Importance of the "FATWA" and its value in the Islamic law, he also clarified how much it is related to the purposes of "SHARIA", and its necessity in the consolidation of the "FATWA". As the researcher did originate the matter of taking into account the purposes and the intentions in the "FATWA", as he did originate the theory of motivation, he also announced the FOUKAHA'S different opinions in this subject. As he also show the Importance paths, ways and mechanisms which the "MUFTI" may use to detect the purposes and the intentions. In conclusion, the searcher mentioned some of the practices and examples that may be taken out of the mentioned subject.
