واقع الصناعة المصرفية الإسلامية في الجزائر وتحدياتها

Résumé: تعالج هذه الدراسة واقع الصناعة المصرفية الإسلامية في الجزائر والتحديات التي قد تعيق نجاحها، لهذا لابد من التعرف علي هذه التحديات لمواجهتها وتوفير المناخ الملائم للاستفادة من مزايا الصيرفة الإسلامية التي أثبتت وجودها عالميا. وقد خلصت الدراسة إلى أن الصناعة المصرفية الإسلامية في الجزائر عاشت فترتين، الأولى مارس فيها كل من بنك البركة وبنك السلام المعاملات المصرفية الإسلامية في ظل فراغ قانوني خاص بالشريعة الإسلامية وفترة ثانية جاءت بصدور النظام 02/20، وضعت الإطار القانوني والتنظيمي لعمل الصيرفة الإسلامية وفتحت الباب واسعا أمام البنوك العاملة الجزائر لفتح نوافذ إسلامية، أملا في زيادة نفوذ الصناعة المصرفية الإسلامية. لكن مع كل هذا يبقى على كل الأطراف ذات الصلة أن تعمل على دراسة التحديات العديدة المرتبطة بكسب ثقة المتعاملين الاقتصاديين من خلال التوعية وتبسيط المعاملات الإسلامية. وهذا كله يبنى على تذليل العقبات، سواء الشرعية منها أو القانونية والمالية أو لمحاسبية وكذلك المتعلقة بالتأهيل الشرعي للموارد البشرية داخل المصارف. The present research paper aims to shed light on the reality of the Islamic banking industry in Algeria alongside its challenges which may hinder its success. On this basis, it is vital to identify these challenges to confront them and provide the appropriate environment to benefit from the advantages of Islamic banking that has proven its presence globally. On the same token, the findings of the study show that the Islamic banking industry in Algeria witnessed two phases, the first during which both Al Baraka Bank and Al Salam Bank practiced Islamic banking transactions in light of a legal vacuum specific to Islamic Sharia, and a second phase came with the issuance of the 20/02 regulation, which laid the legal and regulatory framework for the work of Islamic banking. Moreover, there is a wide scope for banks operating in Algeria to open Islamic windows, in the hope of increasing the influence of the Islamic banking industry. Nonetheless, all relevant parties need to analyze the several challenges related to gaining the confidence of economic dealers through awareness and simplification of Islamic transactions. All of this is built on overcoming obstacles, whether legal, sharia based, financial and accounting, as well as those related to the legal qualification of human resources within banks.
