الطبيعة القانونية لمبدأ الاحتياط في القانون الدولي للبيئة

Résumé: يعد مبدأ الاحتياط من أهم مبادئ القانون الدولي لحماية البيئة، و الذي يهدف إلى إلزام الدول بعدم التذرع بغياب الدليل العلمي بالنسبة للآثار الضارة للأنشطة الإنسانية على البيئة، و اتخاذ كافة التدابير الاحتياطية اللازمة لتفادي الأضرار المحتملة. غير أن الإشكال يتمحور حول الطبيعة القانونية لهذا المبدأ إذا كان التزام ببذل عناية على حسب إمكانيات الدول أو التزام بتحقيق نتيجة، الشيء الذي له انعكاس كبير في تحديد الالتزامات الدولية. The precautionary principle is one of the most important principles of international law to protect the environment, which aims to oblige states not to invoke the absence of scientific evidence regarding the harmful effects of human activities on the environment, and to take all necessary precautions to avoid potential damage. However, the problem revolves around the legal nature of this principle if it is an obligation to exert due diligence according to the capabilities of states or a commitment to achieve a result, which has a major reflection in defining international obligations.
