التسريح للسبب الاقتصادي – من الرقابة الإدارية إلى التفاوض الجماعي –

Résumé: الملخص: فرضت الإصلاحات الاقتصادية تحولات هامة في قانون العمل الجزائري مست بصفة خاصة علاقات العمل، فأكدت على ضرورة تبني المرونة في تنظيمها سواء في مرحلة إنشائها أو تنفيذها أو إنهائها. تجلت صورة ذلك في مجال التسريح للسبب الاقتصادي وذلك بالمرور من مرحلة الشرعية الادارية إلى مرحلة الشرعية التفاوضية، الأمر الذي يقتضي التساؤل عن جدوى هذا التحول في المساهمة في الوصول إلى التوفيق بين حماية العمل من جهة والحتميات الاقتصادية من جهة أخرى. الكلمات الدالة: التسريح للسبب الاقتصادي، الرقابة الإدارية ، التفاوض الجماعي، المرونة. Le licenciement pour motif économique -du contrôle administratif à la négociation collective- Résumé : Les réformes économiques ont imposé des changements significatifs dans la législation du travail algérienne, notamment les relations de travail, soulignant la nécessité d'adopter une certaine flexibilité dans leur organisation, que ce soit dans la phase de la création de ces relations, leur exécution ou leur mise à fin. Ce fait s'est reflété dans le domaine du licenciement pour motif économique, et ce par le passage de la légitimité administrative à la légitimité de la négociation. Ce qui soulève la question de l'utilité de ce changement dans la contribution à parvenir à une concordance entre sécurité de l’emploi d’une part et impératifs économiques, d’autre part. Mots clés: licenciement économique, contrôle administratif, négociation collective, flexibilité Title: Dismissal for economic grounds - from administrative control to collective bargaining- Summary: The economic reforms imposed significant changes in Algerian labour legislation, in particular the work relationships, which emphasizes the need for adopting certain flexibility in their organization that it is in the phase of creation of these relations, their execution or of their termination. This fact is reflected in the field of dismissal on economic grounds, and this by the passage from administrative legitimacy to the negociation legitimacy. This raises the question of the utility of this change in contributing towards agreement between job security, on the one hand, and economic imperatives, on the other hand.
