دور القضاء الدستوري في حماية الثقة المشروعة
Résumé: يُعَدُّ دور القضاء الدستوري بارزاً في حماية المراكز القانونية للأفراد وحقوقهم المكتسبة؛ بسبب التغيرات المفاجئة أو التعديلات التي تُهدد حقوق الأفراد وتُخالِف توقُّعاتهم المشروعة المبنيَّة على أُسسٍ قانونية، لأنَّ التوقُّعات المشروعة ناتجة عن مبدأ الأمن القانوني الذي يهدف إلى الاستقرار في النظام القانوني واحترام حقوق الأفراد وحرِّياتهم وعدم التَّعدي عليهم بسبب التغييرات المباغتة أو المفاجِئة للقواعد القانونية الصادرة من جميع سلطات الدولة. Abstract : The role of the constitutional judiciary is prominent in protecting the legal status of individuals and their acquired rights. Because of sudden changes or amendments that threaten the rights of individuals and contradict their legitimate expectations based on legal foundations, because legitimate expectations are the result of the principle of legal security that aims to stabilize the legal system and respect the rights and freedoms of individuals and not to violate them due to sudden or sudden changes to the legal rules issued by all authorities Country.
