التحريض الالكتروني على الانتحار تحد جديد أمام التشريعات الجزائية ( لعبة الحوت الأزرق نموذجا)electronic Incitement To Suicide Is A New Challenge Before Criminal Legislation ( The Blue Whale Game )

Résumé: ملخص تعد جريمة التحريض الالكتروني على الانتحار من أهم المواضيع التي لم تحظى بالدراسة والتحليل بالرغم من انتشارها عبر نطاق واسع في العالم العربي والغربي في الفترة الماضية، تم ارتكابها بواسطة ألعاب الكترونية تحولت من وسيلة للتسلية والمتعة إلى ألعاب قاتلة تستهدف لاعبيها من الأطفال والمراهقين وتحرضهم على الانتحار في أبشع صوره. وإن كانت مختلف التشريعات الجزائية حاولت إحداث نصوص قانونية خاصة لمواجهة الجريمة الالكترونية بمختلف أشكالها وأوصافها، غير أن هذه القوانين لم تستطع الحد من تفشي الظاهرة كما أنها لم تتمكن من ردع مرتكبي التحريض الالكتروني على الانتحار بصفة خاصة بسبب جملة من الصعوبات القانونية لعل من أبرزها زع صفة التجريم عن فعل التحريض ذاته في قانون العقوبات، وصعوبات أخرى عملية تعتري عملية منع الجرائم التي تتم عبر الوسائط الالكترونية. Abstract: crime of electronic incitement to suicide is one of the most important electronic crimes that have not been studied and analyzed, despite its spread across a wide range in the Arab and western world in the past period, it was committed by electronic games that turned from a means of entertainment and fun into deadly games targeting its children and adolescent players and inciting them to commit suicide In its worst form Although the various criminal legislations have tried to create special legal texts to confront cyber crime in its various forms and descriptions, however, these laws have not been able to limit the spread of the phenomenon, nor have they been able to deter perpetrators of electronic incitement to commit suicide in particular due to a number of legal difficulties, perhaps the most prominent of which is the description of the characteristic Criminalization for this incitement act in the penal code, and other practical difficulties in the process of preventing crimes that take place through electronic media.
