الضرر في إطار المسئوليّة التقصيريّة في التشريع العُماني

Résumé: ملخص: يهدف البحث لدراسة موضوع الضرر كركنٍ من أركان المسؤوليّة التقصيرية في التشريع العُماني لما له من أهميّةٍ بالغة ٍ متناولاً جوانبه المختلفة بإتباع المنهج الوصفي والتحليلي لغايات معالجة مشكلة البحث المتمثّلة في خطورة الأضرار التي يتعرّض لها الإنسان مادياً وأدبياً، والتي تتمحور في سؤال رئيسي : ما مدي نجاعة النصوص القانونيّة في معالجة موضوع الضرر وكيفية تقديره ؟ مبيناً بالتحليل كيفية معالجة العيوب والثغرات القانونيّة التي تعتريه ، متعرّضاً لصور الضرر وأنواعه وشروط تحقّقه . هذا وقد خلص البحث إلى عدّة نتائج منها أنَّ المُشرِّعَ العُماني قسّم الضرر إلى ضرر جسدي وضرر مالي على خلاف التقسيمات المتبعة والمتمثّلِة في الضرر المادي والأدبي ، كما خلُص البحث على ضوء النتائج إلى عدّة توصيات من أهمّها : اقتراح بأنْ يتمَّ تقسيم الضرر في التشريع العُماني إلى ضرر مادي وضرر أدبي بدلاً عن التقسيم إلى جسدي ومالي. Abstract: The research aims to study damage as a pillar of civil liability in Omani legislation because of its great importance, addressing its various aspects by following the descriptive and analytical approach for the purposes of addressing the problem which is the seriousness of the damage to which a person is exposed materially and morally, which revolves around a major question: What is the effectiveness of legal texts in addressing the subject of damage and how to estimate it? Indicating the analysis How to address the legal defects and gaps in it, exposed to the forms of damage, its types and conditions to achieve it. The research has concluded several results, including that the Omani legislator divided the damage into physical harm and financial damage, unlike the divisions followed and represented in material damage and moral damage, as the research concluded in the light of the results to several Recommendations, the most important of which are: A proposal that damage be divided in Omani legislation into material damage and moral damage instead of dividing into physical and financial.
