Résumé: إن الصياغة القانونية للأحكام الفقهية بما تتطلبه من الشمولية والدقة والإيجاز، قد يعيقه دقة التكييف التي تتطلبها الأحكـام وإحاطتها بجميع الوقائع مهما اختلفت مناطاتها باعتبار المتغيرات الــزمانية والمكانية، والتي تجعلها بحاجة على الدوام إلى صياغة جديدة تتلاءم والمرونة التي اختصت بها، وهذا ما يفـرض تأسيسها على قواعد ومعايير انطلاقا من مبادئ التشريع الإسلامي التي تجمع بين الثابت والمتغير، مواكبة لمتطلبات الحياة ومستجدات العصر عـلى نحـو يحقق الغرض الذي تنشده سياسة التقنين، وهو تحقيق مصالح الدولة، السياسية، والاقتصادية، والاجتماعية. Abstract: As The legal drafting of the provisions of jurisprudence require the inclusiveness, clearness and brevity. This would hampered the adaptation accuracy and the briefing of all facts which this provisions requires, whatever their multifunction concerning the temporal and spatial variables, And that makes it always lacked to a new formulation that fit with its flexibility, and this imposes on establishing its rules and standards on the Islamic legislation's principles that combine both fixed and variable, keeping up with the requirements of life and the modern-day's evolution so as to achieve the purpose desired by the legal drafting, which is to achieve the political, economical, and social interests of the state.
