دور السجون الجزائرية في العملية الإصلاحية

Résumé: أمام استفحال ظاهرة الإجرام في المجتمعات وتغير أنماطه، لم تعد الأساليب العقابية القائمة على الردع كافية وحدها للحد من هذه الظاهرة. و أمام هذا الوضع سعت التشريعات العقابية إلى استحداث آليات وطرق جديدة للحد من هذه الظاهرة، و لكن من خلال إشراك الجناة في هذه العملية و ذلك من خلال إصلاحهم و إعادة إدماجهم في المجتمع. و بناءً على ذلك فإن من بين الآليات التي استحدثتها هذه التشريعات يعد التعليم والتهذيب أحد الطرق التي تعمل على إصلاح الجناة. و تبعاً لذلك تتجلى أهمية الوقوف على ما أقرته التشريعات الحديثة و على موقف التشريع الجزائري من هذين الآليتين كتقنيتين حديثتين و ذلك مواكبة للتطورات الحديثة التي تعرفها الأساليب العقابية. Faced with the growing phenomenon of crime in societies and changing models, punitive deterrent methods are no longer enough to limit this phenomenon. Faced with this situation, punitive legislation has sought to develop new mechanisms and methods to reduce this phenomenon, but through the involvement of the authors in this process through their reform and their reintegration into society. Consequently, among the mechanisms developed by these legislations, education and discipline are one of the means of reforming the authors. Consequently, it is important to resist what has been approved by modern law and the position of Algerian law on these two mechanisms as modern techniques, in keeping with modern developments known as punitive methods.
