خصوصية التفتيش في البيئة الإلكترونية

Résumé: التفتيش هو الاطلاع على مستودع سر الشخص بهدف ضبط أدلة مادية تساعد على ظهور الحقيقة، وهو بهذا يقدم خدمة للعدالة، ولكنه في الوقت نفسه يمس حرمة الحياة الخاصة للأفراد، لذلك أحاطته التشريعات المختلفة بمجموعة من الضمانات، لكن الوضع يدق عندما يتعلق الأمر بالتفتيش في البيئة الالكترونية لما تتميز به من خصائص ومميزات، تفرض في سبيل استخلاص الدليل، الخروج عن القواعد العامة للتفتيش، ولكن دون التضحية بحرمة الحياة الخاصة. Search is the access to a secret place of a person for seizing physical evidence that helps to reveal the truth, and in this way, it does a service to justice, but at the same time it affects the sanctity of the privacy of individuals, therefore various legislations have surrounded it with a set of guarantees. The situation becomes delicate when it concerns the inspection in the electronic environment, which is distinguished by its characteristics, which impose to extract evidence, deviate from the general rules of inspection, but without sacrificing the sanctity of privacy.
