مستجــدات الإصلاحـــات الدستـــــورية حــول سلطــة رئيـــس الجمهــورية في تعديـــل الدستــــور (الجـــزائـــر، تــونـــس أنمـــوذج)

Résumé: ملخص: إن كون الدستور وثيقة سياسية وكذلك أسمى وثيقة قانونية في تنظيم الدولة في نفس الوقت، مبرر في حد ذاته لتشديد إجراءات المراجعة الدستورية، ويقتضي التحلي بأكبر قدر من المسؤولية والخبرة والمهارات في صياغة النصوص القانونية، ولعل من بين الأهداف التي تدفع إلى الحد من الجهات المخولة بالمبادرة بتعديل الدستور، وعدم جعل هذه الصلاحية من الاختصاص الحصري لسلطة معينة على حساب باقي السلطات هو إعطاء القيمة الحقيقية للنص الدستوري ووقايته من الممارسات التي تنتقص منه، وهي جهات محددة طبقا للدستورين الجزائري والتونسي في كل من رئيس الجمهورية والبرلمان، ولقد نص المشرع الدستوري الجزائري بموجب تعديل 2020 على جملة من الأحكام الإجرائية والموضوعية التي تحكم سلطة رئيس الجمهورية في تعديل الدستور، وهو الأمر نفسه الذي نص عليه الدستور التونسي لسنة 2014. Abstract: The fact that the constitution is a political document as well as the highest legal document in the organization of the state at the same time, justification in itself to tighten the procedures for constitutional review, and requires the greatest responsibility, experience and skills in drafting legal texts, and perhaps among the goals that push to limit the parties authorized to initiate By amending the constitution, and not making this authority the exclusive jurisdiction of a particular authority at the expense of the rest of the authorities is giving the true value of the constitutional text and protecting it from practices that detract from it, which are specific bodies according to the Algerian and Tunisian constitutions in both the president of the republic and the parliament, The Algerian constitutional legislator has stipulated, according to the 2020 amendment, a set of procedural and substantive provisions governing the authority of the President of the Republic to amend the constitution, which is the same as stipulated in the Tunisian constitution of 2014.
