قمع الجريمة الانتخابية على ضوء الامر الامر 21-01 المتضمن القانون العضوي المتعلق بنظام الانتخابات

Résumé: في هذه الورقة البحثية سنتناول موضوع الجرائم الانتخابية الذي يعد موضوع هام سواء من الناحية السياسية أو القانونية لكونه الجريمة الانتخابية تؤثر على سير العملية الانتخابية و نزاهتها. و لقد حرص المشرع الجزائري بموجب الامر 21-01 المتضمن القانون العضوي المتعلق بنظام الانتخابات على تجريم الأفعال التي من شأنها المساس بالعملية الانتخابية في مراحلها المختلفة، من خلال متابعة مرتكبي تلك الجرائم و معاقبتهم بالعقوبات المناسبة تماشيا مع خطورة وجسامة الفعل المرتكب و اثره على سلامة العملية الانتخابية بصفة عامة. In this research paper, we will address the topic of electoral crimes, which is an important subject both politically and legally, as electoral crimes affect the conduct and integrity of the electoral process. The Algerian legislator, through ordinance 21-01 containing the organic law related to the electoral system, has been keen to criminalize acts that may undermine the electoral process at its various stages. This is achieved by prosecuting the perpetrators of these crimes and imposing appropriate penalties in line with severity and seriousness of the committed act and its impact on the overall integrity of the electoral process.
