العفو عن القاتل غيلة في الفقه الاسلامي والقانون الجزائري الجزائري: دراسة مقارنة

Résumé: كان القتل العمد ولا يزال جريمة بشعة للغاية ، فمرتكبها محكوم عليه بأشد العقوبات في جل القوانين البشرية ، والتي لم تتردد في إظهار القسوة اتجاهه ، ولا سيما القتل المشهور في الفقه الإسلامي بالقتل غيلة- خديعة- ، أو ما هو معروف في قانوننا الجنائي بالقتل مع سبق الإصرار والترصد . فالعفو لا يمكن أن يمس شخصا استعمل الغدر ، والخديعة ، وسبق الاصرار ، والترصد لأجل النيل من ضحية لم يكن في حسبانه أنّه ماض لحتفه ، وكان طامعا أنّه ذاهب لمأمنه ؛ فيأخذه المجرم على حين غرّة من أمره فيرديه قتيلا ، وربما غيّب جثته عن الأعين ، أو أبادها حتى لا يُوجد لها أثر. ولقد كان الهدف من هذا المقال تسليط الضوء على ما رصدته الشريعة الاسلامية ، والقانون الجزائي الجزائري من عقوبة صارمة للقاتل غيلة وخديعة ، والتنويه على أنّ هذا الجرم لا يتنازع في بشاعته واضعوا الشرائع ، ومن يرومون إصلاح الجماعة البشرية ، وإن كان هناك تفاوت في مضمون تلك الصرامة ، وذلك التشدد . Willful killing was and still is an extremely heinous crime, and its perpetrator is sentenced to all laws, which did not hesitate to show cruelty towards him, especially the well-known murder in Islamic jurisprudence with murder - deceit - or what is known in our criminal law, with premeditated murder.
