قراءة في التنظيم القانوني لعمل المرأة ليلا على ضوء القانون 90/11 - دراسة مقارنة -

Résumé: لقد أصبح الوضع المتجدد للمرأة داخل المجتمع، يؤهلها للقيام بأدوار إيجابية وفعالة فيه، ويبين قدراتها وإمكانياتها الخلاقة، ولقد أصبحت الحماية التي حظيت بها جانبا هاما من الأهداف التي يسعى المشرع الجزائري لتحقيقها، لاسيما من حيث تضمين التشريع العمالي، قواعد قانونية وأخرى تنظيمية تماشيا مع أحكام الاتفاقيات الدولية للعمل، مُقررة لأحكامٍ حمائية للمرأة العاملة، تتميّز فيها إيجابياً عن فئة الرجال بتدابير إجرائيّة خاصّة بها، استناداً إلى اختلافِ بُنيَتها الجسديّة، وبحُكْمِ وظيفتِهَا الطبيعيّة(الأمُومة) وكذا مسؤولياتها العائلية، على أن أهم تلك التدابير، إنما يتمثل في تلك المتعلّقة بحَظْرِ عملها الّليلي، رغم اختلاف الآراء الفقهية فيما يتعلق بعمل النساء ليلا، بين مؤيد له ومعارض. غير أن المشرع الجزائري اكتفى بنص عام يقر فيه مبدأ المنع، كما منح سلطة تقديرية واسعة لمفتش العمل، لتقدير الأسباب التي يسمح للمستخدم بموجبها الالتجاء للعمل الليلي، في غياب نص دقيق وواضح حيث ترك أمر تحديد تفاصيله للاتفاقيات الجماعية. Abstract: The renewed situation of women in the community has enabled them to play effective roles, demonstrating their capacity, its protection has become an important part of The objectives that the Algerian legislator seeks to achieve, particularly in terms of include legal and regulatory rules in labor legislation, Consistent with the provisions of the International Labor conventions, established protective measures for working women, the most important, are the measures related to the prohibition of women’s night work, despite the divergence of the doctrinal views, regarding between the advocates and opponents. The Algerian legislator have enough with a general text recognizing the principle of prohibition, also given a wide discretion to the labor inspector, to estimate the reasons under which, the user is allowed to resort to night work, in the absence of a accurate and clear text, he left the detail command to the collective labour agreements.
