الإشكالات الإجرائية للتفتيش دراسة موضوعية مقارنة بأحكام القضاء

Résumé: يعالج موضوع البحث أهم الموضوعات الإجرائية التي تقوم بها السلطة العامة في مواجهة الأفراد، والمتضمنة تفتيش الأشخاص والمساكن، مما اعتبر من أخطر الإجراءات التي تمس بالحقوق والحريات المكفولة في المواثيق الدولية والدساتير. إلا أن مصلحة الكشف عن الحقيقة بررت القيام بإجراءات التفتيش وضبط الأشياء، ولما كانت الغاية من إجراء التفتيش هي جمع الأدلة، إلا أن القانون لم يترك ذلك بإطلاق، وإنما قيده بمجموعة شروط شكلية وموضوعية لترتب الأثر المشروع كما أحاطه بجملة من الضمانات أثناء عملية التنفيذ تحقيقا لسلامة الضبط ومنعا من التعسف في استعمال الحق. ومما تجدر الإشارة إليه، أن إجراء التفتيش طابعه ميداني أكثر منه نظري، لهذا تراعى فيه الجوانب الإنسانية والحقوق الأساسية تماشيا مع روح القانون وتحقيقا للعدالة المطلوبة. Abstract: The topic of the research deals with the most important procedural issues that the public authority undertakes in confronting individuals, which includes inspecting their persons and homes, which is considered a violation of the rights and freedoms guaranteed in international charters and constitutions. However, the interest of revealing the truth justified carrying out inspection procedures and seizing things, and since the purpose of conducting the inspection was to collect evidence, the law did not leave that out at all, but rather restricted it to a set of formal and objective conditions to arrange the legitimate effect as it surrounded it with a set of guarantees during the implementation process in order to achieve the safety Control and to prevent abuse of the right. It is worth noting that the inspection procedure is more field-based than theoretical, and therefore human aspects and basic rights are taken into account in line with the spirit of the law and in order to achieve the required justice.
