قراءة في القرار المشيخي الصادر في 22 أفريل 1863 A Reading In The Sénatus Consulte Of 22 April 1863

Résumé: عرفت الجزائر إبان فترة الإحتلال الفرنسي عددا من أنواع التشريعات الخاصة بها دون غيرها من المستعمرات. كان منها القرار المشيخي المؤرخ في 22 أفريل 1863 الخاص بملكية الأراضي الجزائرية على تعدّد أنواعها كأراضي الملك، وأراضي البايلك، والعرش، والمخزن، وغيرها. فطالت أيدي المستعمر هذه الأراضي في بداية الإحتلال بالمصادرة، ثم أخذت في العمل على تحقيق عدة أهداف من خلال القرار المشيخي المذكور كوضع حدّ للملكية الجماعية مقابل إنشاء ملكية فردية قصد إجبار الفلاحين على بيع أراضيهم، وتسهيل عملية انتقال ممتلكات الأهالي إلى أيدي الكولون عن طريق إجراء صفقات تجارية بينهما وصولا في الأخير إلى فرنسة الأراضي، وتفكيك البنية الإجتماعية للقبائل الجزائرية. وقد تنبه الأهالي لخطورة هذا القرار، وردّوا عليه بالرفض واعتبروه معولَ هدمٍ للروابط العائلية. During the French occupation, Algeria experienced a number of types of legislation of its own, not as the other colonies. Among them was The Law of The Senatus Consulte of April 22, 1863, on the ownership of Algerian land with its different kinds, such as the Melk land, the Beylikal lands, the Arch, the Mekhzen, etc. The colonizer’s hands extended these lands at the beginning of the occupation by confiscation, then began to work to achieve several goals through the aforementioned Senatus Consulte decision such as putting an end to collective ownership in exchange for the establishment of individual ownership in order to force peasants to sell their lands. Moreover, and to facilitate the process of transferring the people’s property to the hands of the Colons by making trade deals between them, eventually reaching the Francisation of the lands, and the dismantling of the social structure of the Algerian tribes. The people were aware of the seriousness of this decision, and they responded by rejecting it, considering it a tool that destroys family ties.
