السياسة العقابية لمكافحة المخدرات و المؤثرات العقلية في التشريع الجزائري

Résumé: يعتبر الاتجار و الاستعمال غير المشروعين للمخدرات و المؤثرات العقلية من الآفات العالمية التي تؤثر سلبا على النسيج الاجتماعي للدول التي تعاني منها على غرار الجزائر، و على اقتصادياتها. في سبيل مكافحة جرائم الاتجار و الاستعمال غير المشروعين للمخدرات و المؤثرات العقلية تبنى المشرع الجزائري سياسة عقابية خاصة، حيث رتب من جهة عقوبات متنوعة على مرتكبيها سواء كانوا أشخاص طبيعية أو معنوية، و نص على تشديد مقدارها متى اقترن ارتكابها بظروف من شأنها أن تجعلها أكثر جسامة، و من جهة أخرى لوجود مصلحة أولى بالرعاية من مصلحة العقاب نص على الإعفاء أو التخفيض من العقوبة. إن مواجهة خطورة هذه الآفة التي أصبحت آثارها تتجاوز الحدود الإقليمية للدولة الواحدة و الوقاية منها تحتاج لوضع سياسة عقابية رادعة و شاملة مع أن فعالية الإطار التشريعي تبقى قائمة على الآليات المسخرة لوضع أحكامه موضع التنفيذ. the illlicit trafic and use of narcotic drugs and psychotropic substances is a global pest that negatively affects the social fabric of the countries that suffer from them such as algeria,and their economies. in order to combat the crimes of trafficking and illicit use of narcotic drugs and psychotropic substances, the algerian legislator has adopted a special punitive policy. on the other hand, because there is a primary interest in the welfare of the punishement, it provides for exemption or reduction of punishement. confronting the gravity of this scourge, whose effects have transcended the territorial boundaries of a single state and its prevention, needs to establish a comprehensive and deterrent punitive policy, although the effectiveness of the legislative framework remains based on the mechanisms put in place to implement its provisions.
