سلطة ضبط السمعي البصري: قراءة في المهام والصلاحيات

Résumé: أنشئت سلطة ضبط السمعي البصري في الجزائر لأول مرة بموجب المادة 64 من القانون العضوي 12-05 المتعلق بالإعلام، و التي اعتبرتها سلطة ضبط مستقلة، كما نظمت اختصاصات وتشكيلة وسير سلطة ضبط السمعي البصري بموجب القانون 14-04 المتعلق بالنشاط السمعي البصري، الذي خصص لسلطة الضبط إضافة للمواد المتفرقة المتعلقة ببعض الاختصاصات باب كامل يضم أكثر من ثلاثين )30( مادة تضمنت العديد من مظاهر الاستقلالية من الناحيتين العضوية والوظيفية، بالإضافة إلى بعض القيود التي فرضها المشرع على سلطة ضبط السمعي البصري كما ترك المشرع في هذه المواد بعض المسائل غامضة تحتاج إلى إعادة ضبط. The Audio-Visual Regulation Authority was created in Algeria for the first time, in virtue of article 64 of the organic law 12-05 relating to media, as an independent regulation authority. The competences and the structure of the Audio-Visual Regulation Authority was regulated by the law 14-04 relating to the audio-visual activity which allocated an integral part containing more than 30 articles to the regulation authority and other various matters concerning some competences. These articles provide for organic and functional independence of this institution, in addition to some restrictions imposed by the law upon the Audio-Visual Regulation Authority. It is worth noting that some issues in these articles are ambiguous and need to be revised.
