Résumé: وضع المشرع الجزائري قواعد تنظيمية للمعاملات الخاصة بنقل وزرع الأعضاء البشرية سواء ما تعلق منها بأطراف العملية ومكانهما او ما تعلق برضا المتبرع وأهليته القانونية وشروط إجرائها خاصة بعد إنشاء الوكالة الوطنية لزرع الأعضاء، وبالموازاة مع ذلك وضع جزاءات قانونية لحماية التعامل غير المشروع بالأعضاء البشرية حتى لا يستباح جسم الإنسان وتتم المتاجرة بأعضائه. The Algerian legislator has set regulatory rules for the transactions related to the transfer and transplantation of human organs, whether related to the parties of the process and its location or related to the consent of the donor and his legal capacity and conditions for its conduct, especially after the establishment of the National Agency for Organ Transplantation, and in parallel with this, legal penalties are set to protect this from illegal dealings with human organs so that the human body is not desecrated and its organs are not traded
