حكم عقود بيع الخضروات مغيبة الأصول كما يجريها فلاحو وادي سوف -عقود بيع البطاطا أنموذجا-

Résumé: ذهب الباحث يوسف حدد في كتابه: "المخالفات الشرعية في بيع الخضروات مغيبة الأصول في البساتين-دراسة فقهية مقارنة- فلاحو ولاية الوادي أنموذجا" إلى بطلان عقود بيع البطاطا على الصفة التي تتم بين التجار وفلاحي منطقة وادي سوف؛ واستند في ذلك على احتوائها على ثلاث مخالفات شرعية: الأولى: أن بيع الخضروات مغيبة الأصول لا يجوز إلا بثلاثة شروط، والصفة التي يتعاقد بها الناس اليوم في بيعها لم تستجمع تلك الشروط، والثانية: أن في الصفة التي يبيع بها فلاحو ولاية الوادي الخضروات مغيبة الأصول جهالة تستلزم القول بتحريمها، والثالثة: أن تلك العقود محرمة من جهة أخرى لما فيها من ابتداء الدين بالدين؛ وقد اعتمدت في هذا البحث على المنهج النقدي من أجل مناقشة تلك الشبهات الثلاث التي أوردها مناقشة علمية؛ وخلص البحث إلى صحة تلك العقود لعدم احتوائها على مخالفات شرعية تستلزم القول بإبطالها وتحريمها. Abstract: Researcher Youcef Heded Insisted in his book: “Sharia violations in the sale of root vegetables: a comparative fikh study - farmers of province of Eloued as a Model” on the Nullity of contracts for the sale of potatoes as carried out by the merchants and the farmers of the Wadi Souf region; He based this on the fact that it contained three Sharia violations: the first: that selling root vegetables is not permissible except with three conditions, and These conditions do not exist in people's transactions today, The second: that in the process of selling vegetables, contain ignorance, which necessitates saying that they are forbidden, The third: that these contracts are prohibited because of what they contain from the start of debt in exchange for debt; In this research, I have relied on the critical method in order to discuss those three suspicions that were mentioned by a scientific discussion; The research concluded that these contracts are permissible because they do not contain Sharia violations that necessitate saying that they are invalid and prohibited.
