أثر فترة الريبة في تصرفات المدين المفلس الضارة بالدائنين The Effect Of The Uncertainty Period On The Bankrupt Debtor's Harmful Behavior To Creditors

Résumé: إن حماية الدائنين من المدين المفلس والمساواة فيما بينهم، يمثل قوام نظام الإفلاس، لا يكفي لتحقيقهما غل يد المدين عن أمواله وما يستتبعه من عدم نفاذ تصرفات المفلس اللاحقة على شهر إفلاسه في مواجهة جماعة الدائنين، لذلك فقد أقر المشرع حماية خاصة لهم بمقتضى المادة: 247 من القانون التجاري، وهو ما يعبر عنه بعدم النفاذ الوجوبي، والتي تختلف عن تلك المتعلقة بالدعوى البولصية المنظمة في الأحكام العامة . إن أثر الحكم بعدم النفاذ الوجوبي لتصرفات المدين يترتب عليه رد ما تم التصرف فيه إلى التفليسة ويدخل أصحابها كدائنين عاديين ويشتركون في قسمتها قسمة غرماء. ABSTRACT The protection of creditors from the bankrupt debtor and the equality among them represent the basis of the bankruptcy system. It is not sufficient for them to achieve the debtor’s hand for his money and the consequent non-enforcement of the bankrupt’s actions subsequent to the declaration of his bankruptcy vis-à-vis the group of creditors. Therefore، the legislator approved special protection for them according to Article 247. From the commercial law، which is expressed in the lack of compulsory enforcement، which differs from that related to a police suit organized in general provisions. The effect of the ruling of non-compulsory enforcement of the debtor's actions entails returning what has been disposed of to bankruptcy، and its owners enter as regular creditors and share in the division of the debtor.
