الاستشارة البيئية آلية للشراكة بين الجمعيات البيئية والجماعات الإقليمية في ترقية القرار البيئي المحلي

Résumé: بما أن الجماعات الاقليمية المتمثلة في البلدية والولاية، هي المسؤولة على المستوى المحلي، فلقد مكنها المشرع الجزائري من مجموعة متعددة من المهام والصلاحيات، والتي من بينها حماية البيئة للمحافظة على صحة مواطنيها وإطارهم المعيشي بالشراكة مع جمعيات حماية البيئة بواسطة مجموعة من الاليات والتي من بينها آلية الاستشارة البيئية، والمشرع الجزائري حاليا وسع من تكريس هاته الألية ضمن القوانين المنظمة للجماعات الاقليمية وأيضا عبر القوانين والمراسيم ذات الصلة بحماية البيئة، لأن لها تأثير في ترقية القرار البيئي المحلي، ولكن يجب عليه أن يلزم الجماعات الاقليمية باستشارة الجمعيات البيئية في ما يتعلق بالمشاريع ذات العلاقة بالبيئة، ولا يترك لها حرية سلطة اتخاذ القرار، وأن يأخذ برأي الجمعيات البيئية بعد استشارتها لكي يكون له تأثير فعلي على القرار البيئي المحلي. Since the regional groups of the municipality and the wilaya are responsible at the local level, the Algerian legislator has enabled it to carry out a variety of tasks and authorities, including protecting the environment to preserve the health and livelihood of its citizens in partnership with environmental protection associations through a variety of mechanisms, Environmental consultation. The Algerian legislator has now expanded this mechanism within the laws governing regional groups as well as through laws and decrees related to environmental protection because they have an impact on the promotion of the local environmental decision, To consult environmental associations in relation to projects related to the environment, and leaves her freedom of decision-making authority, and to take the opinion of environmental associations after consultation in order to have a real impact on the local environmental decision.
