التأمينات الإلزامية في مجال البناء

Résumé: تناولنا في هذه الورقة البحثية التأمينات الإجبارية التي يخضع لها كل من المقاول والمهندس المعماري والمراقب التقني، وكل متدخل في عملية البناء، حيث أن كل شخص تدخل في عملية البناء يلتزم بتأمين مسؤوليته المدنية المهنية أثناء عملية البناء وتنفيذ الأشغال، بالإضافة إلى تأمين المسؤولية المدنية العشرية بعد التسليم النهائي للأشغال، وجاء المشرع الجزائري بهذه الإلزامية في نص المادة 175 والمادة من الأمر 95-07، وذلك بهدف ضمان المؤمن له من عدم رجوع الغير عليه بالمسؤولية في حالة تحقق الخطر هذا من جهة، ومن جهة أخرى حماية الغير الذي قد يصيبه الضرر نتيجة تحقق ذلك الخطر المؤمن منه.
