الحماية الجنائية لقواعد القانون الدولي الإنساني

Résumé: شهدت البشرية خلال القرون الأخيرة عديد الحروب والنزاعات المسلحة، ارتكبت خلالها أبشـع الانتهاكات الجسيمة للقانون الدولي الإنساني و أدت إلى طمس كثير من معالم الحضـارة الإنسانية، واستباحت الكثير من شرائع الله وقوانين البشر، وهو ما أيقض ضمير المجتمع الدولي من خلال سنه لمجموعة من الاتفاقية التي تحمي المدنيين من أهوال الحرب و كان أبرزها على الإطلاق اتفاقيات جنيف 1949. كما كان إنشاء المحكمة الجنائية الدولية علامة فارقة في تأسيس قضاء جنائي دولي دائم بعد تجارب القضاء الدولي العسكري و القضاء الجنائي الدولي الخاص، لمحاكمة و معاقبة المسؤولين عن الانتهاكات الجسيمة للقانون الدولي الإنساني، فكان بمثابة أسمى أنواع الحماية و أخطرها و هي الحماية الجنائية لقواعد القانون الدولي الإنساني. Abstract: Humanity has witnessed numerous wars and armed conflicts in recent centuries, during which the most heinous violations of international humanitarian law were committed, leading to the obliteration of many aspects of human civilization. These conflicts violated divine laws and human laws, prompting the international community to awaken its conscience by enacting a series of conventions to protect civilians from the horrors of war, with the most prominent being the Geneva Conventions of 1949. The establishment of the International Criminal Court was a landmark in establishing a permanent international criminal justice system, after experiences with military international justice and special international criminal justice, to prosecute and punish those responsible for serious violations of international humanitarian law, serving as the highest form of protection and the most dangerous, namely criminal protection of the rules of international humanitarian law.
