الخلع في القانون والقضاء الجزائريين

Résumé: ملخص: يثير موضوع الخلع إشكالية مدى انسجام موقف المشرع من خلال تنظيم أحكام الخلع في قانون الأسرة وموقف القضاء من ذلك. على هذا الأساس، تكمن أهمية دراسة الموضوع في إبراز موقف القانون الجزائري من هذه الضمانة القانونية في فكّ الرابطة الزوجية، خاصة بعد تعديل القانون رقم 84-11، يتضمن قانون الأسرة بموجب الأمر رقم 05-02، بتبني المشرع موقفاً جديداً يدعّم بمقتضاه المركز القانوني للمرأة المتزوجة. فضلا عن هذا، سيتم التركيز على التذبذب الحاصل في اجتهاد المحكمة العليا حول موضوع الخلع وشروطه إلى جانب التطرّق لأهم الأحكام الإجرائية واجبة التطبيق بشأن إنهاء العلاقة الزوجية بطريق الخلع. الكلمات المفتاحية: الخلع، الشروط، سير الدعوى، دور النيابة العامة، الطعن في الحكم. Abstract: The question of "khol'â" raises the issue of the consistency of the position of the legislator, through the provisions it has instituted to regulate it in the family code, and the position of case law on this subject. This study finds its importance in its objective which aims to highlight the position of Algerian law on this legal guarantee in the dissolution of the marital bond, in particular after the modifications made to the law No. 84-11 relating to the family code by the Ordinance No. 05-02 and by which the legislator adopted a new position which consolidates the legal status of married women. In addition, emphasis will be placed on the fluctuations of the Supreme Court's jurisprudence on the issue of "Khol'â" and its conditions, in addition to addressing the most important applicable procedural provisions regarding the termination of the relationship marriage by means of the "khol'â".
