فقه الأقليات المسلمة بين الاعتبار و الإنكار

Résumé: من المعلوم أن فقه الأقليات لم يكن شائعا معروفا إلا في العقود الأخيرة باعتبار أن الداعي الوجود الإسلامي خارج دار الإسلام ، هذا الوجود الذي لم يكن ظاهرة إنما وجودا عارضا، فكانت الدعوة ملحة إلى إيجاد تأطير شرعي لهذا النازلة منخلا إيجاد حكم فقهي خاص يكتسي الاختصاص من نوعية الواقع و الفوارق الجوهرية بين واقع الأقليات والأكثريات ، فبينما تحمس البعض إلى هذا الفقه اعترض آخرون وأثاروا جملة من القوادح والشبه ،فجاء هذا المقال يدرس مقالات كلا الفريقين قبولا واعتراضا؛ خلوصا إلى القول الصحيح القاضي بمشروعية هذا الفقه القائم على رعي الفروق والأحوال في تحصيل الأحكام وتنزيلها. Abstract: It is well-known that the jurisprudence of minorities was not common and well-known except in recent decades، considering that the reason for the Islamic presence outside the abode of Islam is this existence that was not a phenomenon but rather an accidental existence. The reality and the essential differences between the reality of minorities and majorities. While some were enthusiastic about this jurisprudence، others objected and raised a number of quarrels and similarities، so this article studies the articles of both groups، acceptance and objection; Conclusion to the correct saying that judges the legitimacy of this jurisprudence based on the consideration of differences and conditions in the collection and transmission of rulings
