المثول الفوري الاجراء المستحدث بموجب الأمر 15/02 للتبسيط محاكمات الجنح المتلبس بها

Résumé: تم في هذه الدراسة التطرق إلى إجراء المثول الفوري الذي استحدث بموجب الأمر 15/02 المعدل والمتمم للقانون الإجراءات الجزائية، من اجل تبسيط إجراءات محاكمات الجنح المتلبس بها والتي تعتبر بسيطة ولا تتطلب إجراء تحقيق، عن طريق مثول المتهم فورا أمام رئيس قسم الجنح للفصل في القضية في الحين، استثناءً لبعض الحالات التي تم النص عليها في المواد من 399 مكرر إلى 365، وتهدف هذه الدراسة إلى توضيح شروط تطبيق إجراء المثول الفوري والإجراءات المتبعة لانعقاد الجلسة أمام قسم الجنح، والتطرق إلى الإشكالات والنقائص التي تشوب هذا الإجراء والانتقادات الموجه له. this study addresses the promptly brought procedure, which is newly introduced under the decree 15/02 the amended and supplemented for the code of penal procedures for the sake of simplifying the procedures of flagrante delicto trials. These procedures are simple and don’t require an investigation through the promptly brought of the promptly, except for some cases that have been provided for within articles from 365 duplicated to 399. The conditions of applying the procedure of the promptly brought and the other followed procedures of the hearing before the president of the criminal division have been clarified, besides addressing the problems and deficiencies this procedure is clouded by .and the criticism it faces
