Résumé: ملخص: إن قيام المسؤولية المدنية الطبية في جانب الطبيب يجعل من هذا الأخير مطالب بتعويض المريض المتضرر ،غير أنه و لإثبات قيام جميع أركان المسؤولية الطبية على المريض أي المدعي إثبات الخطأ والضرر وعلاقة السببية بينهما ،الأمر الذي يحول في الكثير من المرات بين المريض وبلوغه حقه في جبر ضرره وذلك نظراً لعدة صعوبات وعوائق يصادفها المريض في سبيل النهوض بعبء اثباته لمسؤولية الطبيب ،الشيء الذي دفع بالفقه والقضاء إلى القيام بعدة محاولات سعياً منهم إلى تخفيف العبء الملقى على كاهل المريض المتضرر ولتذليل الصعوبات أمامه. Abstract: The fundament of medical responsibility inside of the doctor, become this one demanded of patient indemnisation, inside of to improve the stability of all the elements of medical responsibility on the patient defended who must improve the mistake and the damage and the relationship between them, in this way there is many difficulties front of the patient to win his rights, because of that our jurisprudence try again to resolve this handicap of the patient through the different ways to give him his rights and avoid the obstacles
