الأحوال الشخصية للجزائريين المسلمين في نطاق العلاقات الدولية الخاصة بين إحالة الإسناد إلى قانون الأسرة وإحالة الاستناد إلى أحكام الشريعة الاسلامية The Personal Status Of Algerian Muslims In Private International Relationships Between Attachment To The Family Law And Reliance On The Provisions Of Islamic Law

Résumé: تهدف قواعد القانون الدولي الخاص الى تنظيم العلاقات ذات العنصر الاجنبي لاسيما تلك المتعلقة بالأسرة وطالما ترتبط هذه الاخيرة بالمعتقدات الدينية في اغلب التشريعات، فان الاحوال الشخصية للجزائريين للمسلمين تخضع لقانون الاسرة الوطني خاصة وأن نصوص هذه القانون مستوحاة من احكام الشريعة الاسلامية ليسد المشرع الجزائري الذرائع وتحسبا لما قد يطفو من مسائل جديدة لم يغطيها هذا القانون عندما قضى في نص المادة 222 من قانون الاسرة بالإحالة على احكام الشريعة الاسلامية فيما لا يوجد فيه نص. The rules of private international law aim to regulate relations of foreign element, particularly those relating to the family. As long as the latter is linked to religious beliefs in most legislation, the personal status of Algerian Muslims is subject to the national family law, especially since the provisions of this law are inspired by the provisions of Islamic law. The aim of Algerian legislator, when he stated in the text of article 222 addressing the Family Law to refer to the provisions of Islamic law when there is no text, is to prevent the pretexts and in anticipation of the new emerging issues that were not covered by the national law.
