عوائق المحكمة الجنائية الدولية في إرساء العدالة الجنائية الدولية

Résumé: إن إنشاء محكمة جنائية دولية دائمة يمثل بحق خطوة غير مسبوقة في التاريخ الإنساني، من شأنها خلق سلطة قضائية دولية تختص بتأمين سيادة القانون الدولي وتطبيق أحكام القانون الدولي الإنساني وهي هيئة دولية دائمة أنشئت بموجب معاهدة لغرض التحقيق والمحاكمة ضد من يرتكبون أشد الجرائم خطورة موضع اهتمام المجتمع الدولي، وهي جريمة الإبادة الجماعية، والجرائم ضد الإنسانية وجرائم الحرب وجرائم العدوان فالمحكمة الجنائية الدولية الدائمة ليست بديلا عن القضاء الجنائي الوطني، وإنما هي مكملة له، وأن اختصاصها مستقبلي فقط لا يسري على الجرائم التي ارتكبت قبل سريان المعاهدة، ويطبق اختصاصها ضد الأفراد فقط. وعلى الرغم من اعتبار المحكمة الجنائية الدولية منشأة بمقتضى معاهدة إلا أن نظامها الأساسي جسد تصورات أقطاب النظام الدولي الذين لا يريدون نظاما جنائيا دوليا مستقلا يشكل عقبة أمام تنفيذهم وتجسيدهم لتفويض الأمم لهم لضمان السهم الدولي. الكلمات المفتاحية : المحكمة الجنائية الدولية؛ العدالة الجنائية الدولية؛ مجلس الأمن الدولي؛ جرائم الحرب؛ الإحالة. Abstract: The establishment of a permanent international criminal court truly represents an unprecedented step in human history, which would create an international judicial authority competent to secure the rule of international law and the application of the provisions of international humanitarian law, and it is a permanent international body established under a treaty for the purpose of investigating and prosecuting those who commit the most severe crimes A serious matter of concern to the international community, which is the crime of genocide, crimes against humanity, war crimes and crimes of aggression. Prior to the entry into force of the treaty, its jurisdiction is applied against individuals only. Although the International Criminal Court was established under a treaty, its statute embodied the perceptions of the poles of the international system who do not want an independent international criminal system that constitutes an obstacle to their implementation and embodiment of the mandate of nations to them to ensure the international arrow.
